no he TRIED to transfer bodies but sasuke used his sharingan and fought the REAL orochimaru and killed him <.<

It could really be seen that oro is alive in spirit within the transfer realm, but his physical body is dead, and he isnt in control of anything anymore. He is really more like a submissive part of sasuke now. Best way to look at it is an extreme version of Voldermort from Harry Potter. No body, but Oro doesnt even have a conciousness now

oro transfers his MIND... once his truwe form was destroyed he couldnt be brought back >.>
