i was just thinking why is the phoenix available only to low level people some higher level people want it too and why is that it seems irrational.

High level people can get it, it has certain requirements.
It is after all a special tattoo.

You have to clarify more...I came in here thinking low levels can get a phoenix for a mount or something like that...I completly forgot about the tattoo. But Kamui's right, some tattoo's are available until you trigger something in game.

it's true that you have to do something to trigger it but why does it go away after you have triggered that something? I remember seeing the pheonix with my account once and never seeing it again

I never heard of it disappearing by it's self.

I think if you get a DK, because the "special trigger" is reset, it goes away, you have to get it while you have the "special trigger" active.

Getting it on an alt (especially an acad alt) is like breathing, its that easy. To get it on a main, you have to actually use a little effort.
